Plaxico Burress Pleads Guilty, Gets 2 Years in Prison

plaxico-burress-guiltyFormer New York Giants wide receiver Plaxico Burress plead guilty today to felony weapons charges.  The charges stemmed from an incident last season when Burress accidentally shot himself in the leg at a New York night club.  With the guilty plea, Burress was handed a 2-year prison sentence.  If he would have gone to trial, he may have faced up to 3 1/2 years in prison.  Reports say that, with good behavior, Burress’s sentence could be reduced to 20 months.

The shocking part of this story to me was the length of Plaxico’s prison sentence.  I have to agree with Burress’s attorney, Benjamin Brafman, who said, “This was not an intentional criminal act.  In my judgment, a two-year prison sentence is a very severe punishment.”  You know, it can be very difficult in our legal system to make sense of some of the judgment’s passed down.  For example, you’ll remember Dante Stallworth, who accidentally killed a man this offseason while driving under the influence of alcohol.  Stallworth served less than 30 days in jail for his crime, while the only victim in Burress’s offense was himself.  I’m not saying that he shouldn’t be punished.  He was stupid for carrying a loaded gun in his sweatpants to a night club, and I understand the need for him to be punished for breaking the law, but this sentence just doesn’t pass the smell test for me.  I know that you can’t compare crimes across states and compare sentencing in two unrelated cases, but can you honestly tell me that getting drunk and running someone over with your car is a lesser offense than shooting yourself in the leg with a concealed weapon?  What do you think?
